📄 Terms & Conditions – Collaboration with Erwin Stephan

These Terms & Conditions apply to all photo sessions between photographer Erwin Stephan (hereafter referred to as “the Photographer”) and any model (hereafter referred to as “the Model”) who agrees to pose for artistic, erotic, or pornographic photographs for the website www.erwinstephan.nl and related publications, websites or platforms.

1. Nature of the Work

  • The photo session may include nude, erotic, fetish, or pornographic themes.

  • The tone of the work is always artistic, consensual, and collaborative, with mutual respect for personal boundaries.

  • The style may include: sensual portraiture, staged erotic scenes, BDSM-inspired aesthetics, or experimental art concepts.

2. Consent and Release

  • The Model confirms that they are at least 18 years of age and will provide valid ID upon request.

  • A Model Release Form must be signed before the shoot begins, granting the Photographer the right to use the images for:

    • Portfolio use (website, social media, exhibitions)

    • Artistic publications (e.g. magazines, zines, books)

    • Merchandise and promotional materials unless otherwise agreed

  • The Photographer may only sell or license images to third parties with prior written consent from the Model if used outside the agreed-upon platforms.

3. Compensation

  • The collaboration may be:

    • Time for Print (TFP): No monetary exchange. The Model receives a curated digital selection of edited images for personal and promotional use.

    • Paid: The Model receives a fixed fee per session, depending on experience, duration, and content level.
      Indicative rates (Netherlands, 2025):

      • Implied Nude: €75 – €150 per hour

      • Artistic Nude: €100 – €200 per hour

      • Erotic/Pornographic (Solo): €150 – €300 per hour

      • Duo/Hardcore Scenes: €300 – €600 per hour (negotiable, depending on visibility and usage rights)

All fees are discussed and agreed upon in advance of the session. Payment is made on the same day, unless stated otherwise.

4. Model Rights & Image Use

  • The Model has the right to request:

    • Limits on types of poses or themes

    • Review of selected images before publication

    • Anonymity (e.g. no face shown, use of alias)

  • The Model may not alter or sell the photos without prior agreement but may use them for personal promotion(portfolio, social media, OnlyFans, etc.), with credit:

5. Photographer’s Rights

  • The Photographer retains the copyright on all images unless explicitly transferred.

  • The Photographer may crop, edit, and publish the work in a style consistent with his artistic vision.

  • No unauthorized commercial resale or publication of the images may be done by the Model.

6. Cancellations & Conduct

  • Cancellations must be communicated at least 48 hours in advance unless in case of emergency.

  • Both parties are expected to conduct themselves professionally and respectfully. Harassment or boundary violations will immediately terminate the session.

7. Confidentiality

  • Behind-the-scenes agreements, discussions, and non-published material remain confidential.

  • The Photographer commits to safe data handling of all image files and personal information.

8. Final Agreement

By signing the Model Release, both parties acknowledge and accept these Terms & Conditions as binding. Any exceptions or additional agreements must be made in writing.
